This revised affidavit and Notice of Default/Invoice arises from the
most recent and additional
unlawful incarceration by the Josephine County Courts and Sheriff's
Department as depicted in
court records of Josephine County Court Case No 02-CR-0617
and: Case No 03-CR-0170
The total number of days of this living, breathing, flesh and blood,
sentient natural man being held
hostage after being kidnapped by Corporate Josephine County armed
agents on three occasions
stands at 128 days. See additional damages/amended Invoice below.
To reiterate my legal status, as the courts have refused to acknowledge
or prove
otherwise, I, Raymond Ronald Karczewski©, a natural born
American citizen, am a
common man of the Sovereign People arising under the original
jurisdiction of the de
jure Constitution of the united States of 1789 as amended by the
qualified electors of the
several States of the American union and the Northwest Ordinance of
1787 for the
Territories of the de jure united States.
I, Raymond Ronald Karczewski©, AM NOT the defendant. I am
the Secured
Party/Creditor, Holder in due course, and Authorized Representative for
the
Debtor/Defendant RAYMOND RONALD KARCZEWSKI©, named as defendant in
Case Number 02-CR-0617 and Case Number 03-CR-0170. I am not an
accommodation
party nor a surety for the debts of RAYMOND RONALD KARCZEWSKI©, the
defendant named in this case, and am held harmless by RAYMOND
RONALD
KARCZEWSKI© in HOLD HARMLESS AND INDEMNITY AGREEMENT NO:
RRK-050302-HHIA, dated the Third Day of the Fifth Month in the Year of
Our
Lord Two Thousand and Two, against all claims, legal actions, orders,
warrants,
judgments, demands, liabilities, losses, depositions, summonses,
lawsuits, costs, fines,
liens, levies, penalties, damages, interests, and expenses whatsoever,
both absolute and
contingent, as are now due, and as might become due, now existing, and
as might
hereafter arise, and as might be suffered by, imposed on, and incurred
by RAYMOND
RONALD KARCZEWSKI© for any and every reason, purpose, and cause
whatsoever.
Said Hold Harmless and Indemity agreement is filed with the Josephine
County Court
Clerk's office and is part of the court transcript of both cases.
I, Raymond Ronald Karczewski©, am not a surety nor an
accommodation party for the
juristic person defendant. Proof of my Legal Status as Secured
Party/Creditor and Holder
of Supreme Claim over the Debtor/Defendant, RAYMOND RONALD
KARCZEWSKI©,
along with my being held harmless against all legal actions, judgments,
and summonses
brought against the defendant has been submitted and is on the
Josephine County Court
record. Yet this documented proof which calls for an immediate
dismissal of all charges
has been ignored by EVERY Josephine County Court judge whom I have
appeared
before in the last twenty-one (21) months. Their complicity in
the unlawful pressing
forward of this malicious prosecution by Josephine County District
Attorney CLAY E.
JOHNSON has been duly noted.
This is the fifth Affidavit and Notice of Default/Invoice sent to you
as the Director of Josephine
County Department of Human Resources, Risk Management. Post
Office records show that the
original AFFIDAVIT AND NOTICE OF DEFAULT/INVOICE sent on June 16, 2003
to
Attorney deSCHWEINITZ, with a copy routed to you, was not accepted on
June 17th, June 25th,
and July 2nd, 2003, and therefore returned by the Post Office to my
wife Anita on July 15th,
2003 (twenty nine days after it was sent) unopened as being unclaimed.
Josephine County
is presently in default.
The revised figures in this Invoice arise from the subsequent unlawful,
unconstitutional and
criminal actions committed by eight (8) STATE OF OREGON CIRCUIT COURT
JUDGES and
DISTRICT ATTORNEY CLAY E. JOHNSON for the COUNTY OF JOSEPHINE and other
members of the State and County Governments in the exercise of unlawful
arrest, incarceration
and court proceedings (See above No 02-CR-0617 and No
03-CR-0170). A complete picture of

I draw further attention
to the Oct.4, 2003 communication to Circuit
Court Judge WILLIAM G.

Neither official has answered the communications as of this date April
24, 2004. The State of
Oregon and County of Josephine has NOT proven Jurisdiction in writing
over this living,
breathing, flesh-and-blood, sentient natural man in these two cases
throughout the last 21 months
as the law requires, nor has the Prosecution and/or Court produced
anyone willing to swear under
oath and upon his own personal unlimited commercial liability in
pressing a claim against me.
According to Common Law, the law in which I derive my Rights, without a
victim no crime has
been committed. Both court proceedings were thus a sham and a
fraud.
I state the following Maxims of Commerce recognized by the
International Law of Commerce.
1. All are equal under the law (both moral and natural law).
2. In commerce truth is sovereign.
3. Truth is expressed by means of an affidavit.
4. An unrebutted affidavit stands as the truth in commerce.
5. An unrebutted affidavit becomes the judgment in commerce.
6. A matter must be expressed to be resolved.
7. He who leaves the field of battle first loses by default.
8. Sacrifice is the measure of credibility (if one has neither
been damaged nor incurred a risk, and
is unwilling to swear an affidavit -- i.e., "true, correct, and
complete," the commercial equivalent
of, " the truth, the whole truth, and nothing but the truth" -- on his
unlimited commercial liability
for the veracity of his statements and the legitimacy of his action, he
has no credibility, and
therefore no basis for asserting claims/charges or claiming authority).
9. A lien or claim can be satisfied only through rebuttal by
counteraffidavit point-for-point,
resolution by jury, or payment.
A UCC-1 Financing Statement/lien #624711, dated and recorded
06/18/03, was filed by me
with the STATE OF OREGON; CORPORATION DIVISION against JOSEPHINE COUNTY,
A BODY POLITIC.
To date, not one agent for the COUNTY OF JOSEPHINE has come forth to
rebut point-for-point,
my sworn affidavit requesting the COUNTY OF JOSEPHINE to provide proof
of its commercial
claim over this Secured Party/Creditor.
Since all Judges, Prosecutors and Sworn Law Enforcement Personnel in
Josephine
County are bonded and have thus violated their oaths of office to
defend the Constitution,
I ask that their bonds be forfeited unless and until the Court's
Jurisdiction is proven over
this living, breathing, flesh-and-blood, sentient, natural man and/or
the prosecution
produces a Claimant asserting they have been victimized by my actions.
In Common Law,
without a victim there is no crime.
The COUNTY OF JOSEPHINE acting jointly with the State of Oregon in this
matter is in
Default and thus stipulates to the truth of my unrebutted sworn
affidavit requesting proof of the 23
claims, a copy of which was sent to you and is on the court
record.
The prosecution has failed to establish any proof of this natural
man's liability to the Oregon
State Statutes and DMV licensing regulations for which I have been
unlawfully arrested
and incarcerated. Until the Court, a legal fiction, and the Josephine
County District Attorney's
Office can prove JURISDICTION in personam over this living, breathing,
flesh-and-blood,
sentient, natural man of the Sovereign People and/or produce anyone who
has filed a claim under
oath or affidavit and is willing to testify upon their own
personal unlimited commercial liability,
under Common Law, no crime has been committed and the County Of
Josephine jointly with the
State of Oregon in their unlawful arrest and incarceration of this
living, breathing, flesh-and-
blood, sentient natural man for the perceived crimes of the defendant
is liable for the damages
stated below.
