More Bureaucratic Chicanery from the STATE OF OREGON

                                                   by Raymond Karczewski©

At approximately 00:05hrs on Sept., 5, 2002, Deputy MICHAEL S. BURKE of the Josephine County Sheriff's Department cited me on Complaint (Oregon Citation) 8890 for "Driving While Suspended I" ORS/ORD/rule 811.175; "Driving while Uninsured" ORS/ORD/rule 806.010; and "Unlawful Use Lights (fail to dim)."

In the registration/insurance material from my glove compartment I gave to BURKE under threat of arrest, was my Insurance Identification Card.  (See info Below)  Clearly, my insurance was up-to-date; yet Deputy Burke "falsely swore upon the affidavit", i.e. the traffic citation, that I was "driving while uninsured."

Likewise BURKE charged me for driving while suspended while relying upon a "fraudulent" DMV entry on his computer showing my Driver's License had been suspended, even though no contract for a driver's license had existed between me and the STATE OF OREGON since 1999.  How could a nonexistent license then be suspended?  A question every tyrannized drivers license holder ought to be asking themselves about now.

Deputy BURKE has falsely sworn on his citation/complaint.  In essence, BURKE has committed perjury in his attempt to set me up.  It is no surprise that when I asked four times whether I was under arrest and he replied no, that I told him I was going to leave.  It is then he came up with his equally phoney "Felony Eluding an Officer" Charge, and interfering with an officer in the performance of his duties.

It landed a law-abiding, never-before-arrested, 65-year-old retired Police Sergeant, a  living, breathing, flesh-and-blood, natural person in Jail for a total of 34½ days.   That was the beginning of one man's nightmarish relationship with the Josephine County Sheriff's Department and Court System which led to my (local media hushed it up) 33-day-long HUNGER STRIKE in protest of my false arrest and imprisonment.  And you thought you got all the latest news in an accurate and timely fashion, eh?

Traveling in my private automobile with my high beams on?  Well, to that I admit.  But to be taken at gunpoint???

Now to the chicanery at the State level Bureaucracy.  I draw reader attention to a letter I received this day, Nov. 6th, 2002, from the OREGON DMV.
See:  http://www.arkenterprises.com/dmv116.jpg

With all of the focus upon government officials engaged in the unauthorized counterfeiting of my Copyrighted trade-name/trademark spelled in ALL CAPITAL LETTERS on official State and County documents, and the considerable fee attached for the unauthorized use thereof, it is no surprise that this letter from the OREGON DMV
went UNSIGNED by the sender.

The attentive reader will note that just below the address is the line "RE: CUSTOMER ID NUMBER 4142036,"  followed by my date of birth and code number L007.  How many of you reading this understand why the line DID NOT read OREGON DRIVER'S LICENSE 4142036?  They're threatening to suspend my CUSTOMER ID NUMBER, and I'm not even a CUSTOMER!!!

    What's wrong with this picture?

Next, the opening line states that "Our records indicate that you were convicted on 10-04-02 for driving uninsured."  Hell, I was in custody at the Josephine County Jail from Sept. 12, 2002 through Oct. 15, 2002.  I wasn't even aware that I was being tried in traffic court for two unfounded infractions "IN ABSENTIA."  Ah!  But then again, that's Justice in OREGON COURTS!!!

I especially like the DMV's "closing remark".  "If you disagree about being convicted for driving uninsured you should contact the court that convicted you.  DMV cannot remove a conviction from your record without an order from the court."  The old "NOT MY JOB," bureaucratic, buck-passing excuse.  Some things never change when dealing with bureaucrats, do they?

The letter was anonymously sent by "Driver Suspensions Unit."

And you thought your government was here to serve you?  A rather rude awakening, isn't it?
