A Letter to Josephine County District Attorney CLAY E. JOHNSON -- BRING THE REAL CRIMINALS TO JUSTICE!!

Mr. Johnson,

On September 8, 2002, I lodged a written complaint with your office charging Josephine County Sheriff's Deputy MICHAEL S. BURKE and other deputies with the crime of Robbery in the first degree ORS 164.415

Although that letter is contained within my court file Case No. 02-CR-0617, I noted that it also contained a margin note by an unknown author stating that no response was required. My question of you, sir, is, why does the Josephine County District Attorney's office take the position that no response is required to a citizen's charge that
Josephine County Law Enforcement Officers have committed serious crimes?

Josephine County Deputy MICHAEL S. BURKE filed a false sworn statement (Traffic Citation # 8890) when he charged me with "driving while uninsured" and driving while suspended, even though I have had no contract with the State of Oregon for a drivers license since 1999 and was not required to have one as I was not engaged in
Commerce.

My private automobile insurance was up-to-date and in force at the the time of the traffic stop. The proof of such insurance, showing the inclusive dates of 09/01/02 to 03/01/03, was contained within the Registration/Insurance unlawfully acquired by Deputy Burke by his threatening me with ARREST if I did not produce same.

Not only did BURKE violate my 4th Amendment protections against evidence illegally obtained as stated in the U.S. Constitution and Oregon Constitution, which made all evidence gathered thereafter inadmissable as the "Fruit of the Poison Tree," he went as far as to falsify and "pyramid" unfounded charges.

Mr. Johnson, I know not how another would address this issue, but as for me, I DEMAND that the real criminal(s) be brought before the court and put on trial.

I demand that a full investigation be launched into this matter and Deputy Burke and others responsible for this "color of office" abuse of power be brought before the Josephine County Courts and answer to the charges.

As a result of that unlawful false arrest at the hands of Deputy MICHAEL S. BURKE, this living, breathing, natural private person was incarcerated for a total of 34 1/2 days in the Josephine County Jail.

This is an example of what our society faces when those who are sworn to protect and serve, i.e., deputy sheriffs, prosecutors, judges, have no regard for either Truth or Law.

While incarcerated at the county jail, I underwent a 33-day HUNGER STRIKE to protest and bring public attention to the False Arrest and False Imprisonment by the very people who were entrusted to protect the public.

At no time in that 33 days of incarceration was I notified of any other court proceedings pending. I subsequently learned that I was tried "in absentia" in traffic court, and convicted on Oct. 4, 2002 for "driving while uninsured." This conviction arose as a result of BURKE'S falsely-stated, sworn affidavit.

Mr. Johnson, NO MORE COVERUPS. It is time to hold the REAL CRIMINALS, those who hide behind robes and badges, accountable for their crimes.

I so demand that you now do your sworn duty.

I am sending a copy of this to Sheriff Dave Daniel and posting it publicly on the Internet so that all may be held accountable for their actions.

What is the essence of GOD?

What is the measure of a CHRIST?

Is CHRIST CONSCIOUSNESS authentic or is it merely a myth?

Do Christians/conditioned believers live their lives in atonement with the nondualistic essence of Truth or do they live in constant chaos borne of their personal worship of Satanically conditioned (dualistic) Deceptions?

Is it possible for any Civilized Conditioned Entities (Christian or Otherwise) to ACTUALLY rise above their life-long conditioned IGNORANCE?

Must IGNORANCE end for INTELLIGENCE to BE?

Many Spiritual Brothers (CHRISTS) have addressed these questions throughout the ages. Who was there to hear them? Who is there to hear them now?

A CHRIST is a simple man/woman of Truth, one whose balanced essence of consciousness transcends the limited, corrupted, Satanically-driven, dualistic, intellectual mind of Civilized man. He/She is one who is *in this world, but not of it."

The wholistic (holy) simplicity of a CHRIST mirrors the complexity of a Satanic-driven limited Intellect. A CHRIST therefore stands as a Mirror of Truth. He/She simply points out the insanity of all those who attempt to live their lives in adjustment to an Illusory world promoted and sustained by Satanic (dualistic) thought.

A simple Man of Truth is NEVER WELCOME in His Time. He soon is known by the HELL THAT HE RAISES within the ranks of the SATANIC mind controllers and their helpless, hopeless blind believers.

Many are watching the unfolding events of my recent arrest and incarceration. It doesn't quite fit within their concept of CHRIST, the mythical being which they worship and strive to emulate, all the while, knowing fully well they can never reach that "rarified" level of Consciousness. (Welcome to the Satanic catch-22 of "DAMNED
IF YOU DO AND DAMNED IF YOU DON'T!")

Apart from the many private letters of support Anita received while I was incarcerated, few have publicly addressed the deeper issues of Freedom which lie at the core this issue.

Publicly, the Internet newsgroups/forums are inundated with hate-filled, scurrilous, and libelous attacks directed toward me and any other who would dare to stand up and CHALLENGE the "status quo."

I've been writing on the Internet for more than 7 1/2 years. I have warned my spiritual brothers and sisters of the coming New World Order, the coming Tyranny. I have called for a Federal Investigation into the Government/Media, sponsored/supported mind-control/disinformation campaigns. It all came to naught, for I stood alone. The inertia of the civilized human conditioned consciousness was too great for the spectating public to overcome. You see, governments are not moved by Truth, they are moved by NUMBERS which reflect either support or opposition. That's the nature of the Satanic Beast.

I have stopped trying to explain that which the ignorant intellect will not grasp. Yet in my silence, my lack of interaction on the newsgroups/forums, the attacks continue.

Pay close attention to the following posts. Note the hate-filled content which could not continue were it not for cowards who understand and are granted Satanic immunity from responsibility through their use of multiple identities in ambushing and attacking others while hiding in shadows of anonymity. Mighty Strong assertions to arise from cowards who lack the INTEGRITY to back up their words with their true identities, are they not?

Do not jump to conclusions. Do not conclude that I judge them, for I do not. Their actions speak plainly for themselves.

A CHRIST is a simple man/woman of Truth who merely mirrors the insanity when ignoramuses (intellectually limited individuals) strain at their attempts to promote such unmitigated hatred and ignorance as NORMAL behavior.

I hereby give my formal separate apology to Clay E. Johnson, as his handling of this case has been of the utmost professional example. I also formally and separately apologize to Michael S. Burke and his most honorable deputies, who's integrity and patience with me is beyond comprehension. I hope you can find it in your hearts to forgive me of my trespasses and slanderous remarks against you. I am wrong and you are right. Make up your mind, Raymond. Are you guilty, are you innocent. If this letter was indeed sent to the district attorney and the sheriff, it may very well be used against you in court. It seems rather foolish to send a letter that specifies punishment, or are you offering "evidence" that you are not fit to stand trial? From what I have read, you have already been found guilty, the insanity plea only works during the trial-not the sentencing. On 9-12-02, 1:00PM, I appeared at an "out of custody" ARRAIGNMENT stemming from the charges lodged against me by the Josephine County Sheriff's Department on 9-5-02.

An ARRAIGNMENT is a legal proceeding wherein a defendant is advised of the charges *claimed* against him and asked to plead either "guilty," "not guilty," or "nolo contendre." Any and all such pleas place the defendant under the jurisdiction of the court by consent. An arraignment is a one-time appearance. It marks the beginning of the legal process which then allows the case to proceed. At least that is what is supposed to happen -- however, NOT IN JOSEPHINE COUNTY, OREGON.

On September 12th, at the Josephine County, Oregon Courthouse, I challenged the Court (Judge ALLAN H. COON) to prove its jurisdiction over me - this private, living, breathing, flesh-and-blood, sentient, natural person - stating that I was not the person listed as defendant on the complaint. (The name on the complaint is a juristic person, a legal fiction, a corporate entity whose name is spelled in ALL CAPITAL LETTERS.)

I served Judge ALLAN H. COON with papers via his bailiff, advising him that the unauthorized use of my common-law-copyrighted property, MY NAME, carried with it a steep user fee; and that by his use of it during the course of the proceedings, he would be voluntarily entering into a self-executing contract to compensate me for the use of my common-law, copyrighted property.

Coon was visibly upset and ultimately declared that if I was not the defendant listed on the complaint, that he would swear out a warrant for "that person" charging *Failure to Appear,* fixing bail at $10,000.00. He then hurriedly adjourned court and left. Shortly thereafter, this private, living, breathing, flesh-and blood, natural person (not the JURISTIC PERSON listed as DEFENDANT) was arrested in the courthouse hallway on the warrant for failure to appear, even though moments before, I had spoken to the judge from the gallery in his court. So much for the FIRST ARRAIGNMENT.

On 9-13-02, at 1:00 PM while in custody at the Josephine County Jail, I was escorted by Josephine County deputies to attend my SECOND ARRAIGNMENT, presided over by Judge WILLIAM MACKAY at the Jail Courtroom.

When I advised Judge WILLIAM MACKAY that I was not the defendant as listed on the complaint. He told me he would not talk to me. He advised me to secure a writ of Habeas Corpus directing same to the Sheriff of Josephine County. I WAS NOT ARRAIGNED at that appearance.

9-16-02, at 1:00 PM, while in custody, I was escorted by Josephine County deputies to attend my THIRD ARRAIGNMENT, presided over by Judge WILLIAM MACKAY at the Jail Courtroom. This "SECRET ARRAIGNMENT" (not publicly scheduled) prevented any interested party from attending.. I WAS NOT ARRAIGNED at that appearance.

9-20-02 at 1:00PM, while in custody, I was escorted by Josephine County deputies to attend my FOURTH ARRAIGNMENT, presided over by Judge LINDI BAKER at the Jail Courtroom. This "SECRET ARRAIGNMENT," like the arraignment of 9-16-02 by Judge WILLIAM MACKAY, was also not publicly scheduled. As in the prior "SECRET ARRAIGNMENT," it prevented any interested parties from attending. I WAS NOT ARRAIGNED at that appearance. Instead, I was scheduled for another ARRAIGNMENT on 9-23-02.

9-23-02, 3:30 PM, while in custody, I was escorted by Josephine County deputies to attend my FIFTH ARRAIGNMENT, presided over by Judge ALLAN H. COON at the Jail Courtroom. This ARRAIGNMENT was published and attended by my wife at the jail.

Judge ALLAN H. COON again refused to address jurisdiction and entered a NOT GUILTY plea for me against my objections. He then conducted an impromptu preliminary hearing by having the Assistant District Attorney NEIL C. MOREY put deputy MONTROSE on the stand to identify me. MONTROSE was a cover officer and could offer no other testimony. Where was the arresting officer MICHAEL S. BURKE? Why was he not in attendance and/or called to the stand to testify? See:

Subsequent to the testimony, Judge ALLAN H. COON still insisted that the proceedings were not a preliminary hearing but an ARRAIGNMENT -- ONLY IN JOSEPHINE COUNTY!!

10-10-02, 11:00 AM, while in custody, I was escorted by Josephine County deputies to attend my SIXTH APPEARANCE, presided over by Judge ALLAN H. COON. This appearance was not termed an ARRAIGNMENT but a HEARING/PLEA & SET TRIAL. Judge ALLAN H. COON appointed an attorney from the Josephine County Public Defender's office to represent me, AGAINST my objections.

Judge ALLAN H. COON also recommended that I be evaluated by MENTAL HEALTH personnel, and later by the Court-Appointed Attorney Peter Smith to determine my mental competency. It appears to this living, breathing, flesh-and-blood, sentient, competent, natural person that Judge ALLAN H. COON was attempting to reduce my status from a sovereign who did not/would not waive his rights to that of a "ward of the state" - one considered incompetent and therefore unable to assert his God-given rights. No future appearance date was set at that time by Judge ALLAN H. COON.

I was notified in my jail cell on 10-14-02, via Josephine County Deputy CONEY, via a note from Judge COON, that a Jury Trial was set for Wednesday, 10-16-02, two days hence, and asked whether I would attend the trial. (Otherwise they would try me in absentia, much like the wrongful conviction in traffic court for "driving while uninsured.") See:

Deputy CONEY stated that Judge COON demanded an answer. I told CONEY that my answer was this: "Have this matter referred to the Grand Jury, and allow me to testify before them to assist them in making their decision."

An hour or so had elapsed when I was contacted by PETER J.SMITH of the Josephine County Public Defenders office (my first contact with him). He advised me that the twelve-man Jury Trial had been moved up and reset for the following day, Tuesday, 10-15-02. Although I spoke to SMITH, at no time did I acknowledge or authorize
him to represent me. SMITH stated he had no choice, as he was appointed by the court and he would have to be dismissed by the court. My objections did not enter into the picture even though he, PETER SMITH, fully understood and AGREED with my position.

10-15-02, 9:30 AM, while in custody, I was escorted by Josephine County deputies to attend my SEVENTH APPEARANCE, presided over by Judge ALLAN H. COON. This was not an ARRAIGNMENT, nor was it a PRELIMINARY HEARING, but a 12-person JURY TRIAL.

Public Defender Attorny PETER J.SMITH advised Judge ALLAN H. COON that I would be representing myself. I read a statement to the court and advised the court that I did not wish to have Mr. SMITH representing me. Judge COON cut me off and would not let me continue with my statement. I was suffering from the effects of a 33-day hunger strike and was ill prepared with a one-day notice to represent myself in a JURY TRIAL. I asked
for a continuance to look at my options. Judge ALLAN H. COON then offered a conditional release to seek Legal counsel elsewhere and called a recess to allow me to confer with my wife. Acting under the duress of the unlawful incarceration, the effects of the 33-day hunger strike, and my wife's ill health, I accepted, and was released from custody and ordered to appear for a Status Hearing on 11-12-02 at 1:00PM.

Once out of custody and back at home, the letters came - not directly from the court, but indirectly through PETER J. SMITH of the Josephine County Public Defenders office, the very attorney I had not engaged or authorized to act on my behalf.

The first set of unsigned letters from the court were addressed to SMITH. Both were dated Oct. 15th, 2002, the date of my appearance before Judge ALLAN H. COON for trial. Both letters were titled "NOTICE OF SCHEDULED COURT PROCEEDING." One (the status hearing ordered by Judge COON at trial) simply stated "Scheduled Proceeding: APPEARANCE" on 11/12/02 at 1:00PM. The other stated "Scheduled Proceeding: HEARING/PLEA & SET TRIAL" at 12/02/02 at 1:30 PM. Public Defender Attorney PETER J. SMITH's cover letter stated in BOLD letters, IF YOU FAIL TO APPEAR, A WARRANT FOR YOUR ARREST WILL BE ISSUED AGAINST YOU. Clearly this was Josephine County Circuit Court' s unlawful substitution for a lawful summons to appear. It was an enticement to enter into contract through voluntary appearance and thereby confer Jurisdiction to the Court through the waiving of one's Rights.

These letters were followed up by another batch of similar communications from the court through the same circuitous procedure as noted above. The letters received on 10-25-02 (postmarked 10-24-02) were dated Oct. 17th, 2002 by the court, with a cover letter dated 10-23-02 by PETER J SMITH who wrote in longhand, "GO BETWEEN AT - LAW." The unsigned court letter listed for "Scheduled Proceeding:" a DOCKET CALL for 5/02/03 at
8:15 AM, and "TRIAL TWELVE PERSON JURY" for 5/06/03 at 9:30 AM.

The same admonition again appeared on SMITH's cover letter: IF YOU FAIL TO APPEAR, A WARRANT FOR YOUR ARREST WILL BE ISSUED AGAINST YOU. Another phony invitation to appear instead of a valid lawful summons to appear by the court. The tactic used by the court was to skirt the law by employing third party Public Defender PETER J. SMITH as a conduit. All of my appearances before the court, including November 12, 2002, were made under duress and/or in custody, thereby voiding any claim of a valid contract by the Courts..

The reason for the Court's retention of Public Defender PETER J. SMITH was made quite obvious during the Court Appearance on Nov 12, 2002.

During our court interchange, Judge GERALD C. NEUFELD never once uttered my name. Instead, he maneuvered Attorney/Conduit PETER J. SMITH to call out my common-law-copyrighted Trade name/Trademark, my private property. Judge NEUFELD even went so far as to call a recess until Public Defender PETER J. SMITH who had left the courtroom to appear at another case, could be located and brought back to announce
the defendant's name.

Although Judge NEUFELD stated during the ARRAIGNMENT that he would allow me to make a verbal statement if I waited till he disposed of all the other cases before the court, when the time came, NEUFELD REFUSED to allow me to read the statement into the court record. Instead, NEUFELD read the statement silently and said it would be placed in the court file. It was not allowed to be recorded on the Court's tape recorder. NEUFELD continued the case to May 2nd, 2003, and like Judge ALLAN H. COON at the Sept 12th, 2002 ARRAIGNMENT, he then hurriedly adjourned the court and quickly left the room, ignoring my objection.

I do not recognize the CIRCUIT COURT OF JOSEPHINE COUNTY OREGON as being a LAWFUL court, and therefore regard its commands NULL AND VOID and lacking FORCE OF LAW. I am not now acting under duress as the Dec. 2, 2002 Appearance looms. That date will bring the CIRCUIT COURT OF JOSEPHINE COUNTY OREGON to face its MOMENT OF TRUTH!!

I am experiencing what recovering drug addicts refer to as a moment of clarity, and I am reviewing my life's events with a revulsion that must be rivaled only by that which you must feel for me. I freely admit as a convicted felon, that I am guilty of driving a vehicle without a valid driver's license, and without current insurance. The following actions should be given strong consideration for my formal sentencing.

    * Involuntary commitment to a state mental health facility for a term to be determined by my psychiatric

    * Permanent forfeiture of my computer and internet usage privileges.

    * Enrollment in an electronic tracking program for the remainder of my natural life.
    * Public shaming.

I hereby give my formal separate apology to Clay E. Johnson, as his handling of this case has been of the utmost professional example. I also formally and separately apologize to Michael S. Burke and his most honorable deputies, who's integrity and patience with me is beyond comprehension. I hope you can find it in your hearts to forgive me of my trespasses and slanderous remarks against you. I am wrong and you are right.
