Affidavit of Edward-Lewis:Brown© and Elaine-Alice:Brown© of Facts to Challenge Jurisdiction

The living, sentient, free-will natural man and woman known as Edward-Lewis:Brown© and Elaine-Alice:Brown©, Secured Parties, Creditors, and Holders-in-due-Course with unlimited commercial liability, hereinafter “Affiants,” acting with rights granted by life and upheld by all valid and just law declare and attest that the following facts are true, correct, and complete to the best of Affiants’ knowledge and in accord with Affiants’ deeply held spiritual convictions and creed re God Almighty.

Affiants can find no written evidence that the UNITED STATES OF AMERICA/UNITED STATES has any jurisdiction over themselves or over the territory in which they abide, the New Hampshire Republic, which has not been ceded to the UNITED STATES, and believe that none exists, for the following reasons:

The United States is defined in 28 USC 3002(15) as a “federal corporation.”

The United States was incorporated on February 21, 1871, (16 Stat. 419, Chap. 62, 41st Congress, 3rd Session), the purpose being “An Act to provide a Government for the District of Columbia,” reorganized June 8, 1878, (20 Stat. 102, Chap 180,45th Congress, 2nd Session) as “An Act providing a permanent form of government for the District of Columbia.”

“Governments are corporations.” Penhallow vs. Doane’s Administrators, U.S. Supreme Court, (1795).

Corporations are commercial enterprises that are controlled by the Uniform Commercial Code.

HJR-192 of June 5, 1933 states the bankruptcy of the United States Corporation government; a bankrupt corporation has no standing in law to sue, as it cannot prove its existence and solvency.

The corporation, being imaginary, having no reality or substance, with limited liability, cannot create or attain parity with the actual, which has unlimited liability and substance.

Rule 9(a), Federal Rules of Civil Procedure states that a party can challenge the existence, capacity of the opposing party to sue or be sued in order to show jurisdiction; creditors have so challenged by Affidavit of Specific Negative Averment, court has refused/denied, thus denying Affiants of due process.

Uniform Commercial Code, UCC9-307(h) states “Location of United States. The United States is located in the District of Columbia.”

Federal jurisdiction is defined by Article I, Section 8, Cl. 17 of the Constitution for the United States of America (hereinafter “Constitution”) “To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings..”

Affiants are domiciled on private land in the New Hampshire Republic.

“The United States government is a foreign corporation with respect to a state.” 19 Corpus Juris Secundum 541.

Previously submitted ‘Affidavit of Non-corporate Status of Edward-Lewis:Brown© “ and “Affidavit of Non-corporate Status of Elaine-Alice:Brown©” have not been rebutted, and thus stand as true.

As non-corporate, sovereign flesh-and-blood man and woman, created by God, Edward-Lewis:Brown© and Elaine-Alice:Brown© have rights of association, as guaranteed by the First Amendment of the Constitution for the united States of America.

Affiants have chosen not to join/associate with the UNITED STATES/UNITED STATES OF AMERICA/UBS FINANCIAL GROUP corporation, and thus have no obligation to abide by said private corporation’s policies.

In People v. Godfrey, 17 Johns, 225, 233 (N.Y. 1819), Chief Justice Marshall stated, “….to bring the offense within the jurisdiction of the courts of the union, it must have been committed out of the jurisdiction of any state; it is not the offense committed, but the place in which it is committed, which must be out of the jurisdiction of the state.”

Affiants remained in their home, on private land, in the New Hampshire Republic.

The United States Attorney General, is, per the 1994 U.S. Government Manual, (p. 390), “…the permanent representative to INTERPOL…” INTERPOL’s constitution requires that any such representative expatriate his/her citizenship. As such, he has sworn his oath of allegiance to a foreign organization, and not to the United States of America.

Attorneys, by accepting the title of “esquire” are in violation of the Constitution, Article I, Section 9, Clause 8, said title being a British title of nobility, below “knight” and above “gentleman:” “No Title of Nobility shall be granted by the United States: And no Person holding any Office of Profit or Trust under them, shall, without the Consent of the Congress, accept of any present, Emolument, Office, or Title, of any kind whatever, from any King, Prince, or foreign State.”

As per the above paragraphs 8 and 9, said attorneys have no standing to exercise the “practice of law” or to hold any office of trust.

Affiants further claim the following, due to case # 06-CR-00071-01/02-SM being a part of the indictment in case # 09-CR-00030-01/02-GZS:

The INTERNAL REVENUE SERVICE is a foreign agency domiciled in Puerto Rico Trust 62 under Secretary of the Treasury of Puerto Rico.

In DIVERSIFIED METAL PRODUCTS, INC. v. T-BOW COMPANY TRUST, INTERNAL REVENUE SERVICE, and STEVE MORGAN, 93-405-E-EJL, 1993, United States Attorney Betty H. Richardson testified that the INTERNAL REVENUE SERVICE is not a United States Agency.

27CFR 250.11 defines “Revenue Agent. Any duly authorized Commonwealth Internal Revenue Agent of the Department of the Treasury of Puerto Rico.”, this being the only definition of “Revenue Agent” to be found in CFR or elsewhere.

All INTERNAL REVENUE agents, officers, and employees are thus unregistered foreign agents conducting business in America in violation of the Foreign Agents Registration Act of 1938.

INTERNAL REVENUE SERVICE and all its agents, officers, and employees are thus without jurisdiction in the united States of America, and its fifty several union States.

27CFR72.11 states: “Commercial crimes. Any of the following types of crimes (Federal or State): Offenses against the revenue laws; burglary; counterfeiting; forgery; kidnapping; larceny; robbery; illegal sale or possession of deadly weapons; prostitution (including soliciting, procuring, pandering, white slavery, keeping house of ill fame, and like offenses); swindling and confidence; and attempting to commit, conspiring to commit, or compounding any of the foregoing crimes.”

27CFR72.11 confirms the undeniable supremacy and applicability of the UCC in all legal matters in every American courtroom as well as others throughout the world.

27CFR is “Alcohol, Tobacco, and Firearms, which is under the Department of the Treasury/Secretary of the Treasury of Puerto Rico without jurisdiction in the United States of America.

INTERNAL REVENUE SERVICE, domiciled in Puerto Rico, Puerto Rico being a part of the UNITED STATES CORPORATION/UBS FINANCIAL GROUP, does have jurisdiction within the UNITED STATES, that being Washington, DC, the territories and possession.

The purchases of Postal Money Orders occurred on private land, i.e. the West Lebanon post office and Plainfield post office, which are on private property, leased, never having been ceded to nor purchased by the UNITED STATES, and thus not under the jurisdiction of the UNITED STATES. (See #15 above)

Affiants have discharged alleged charge as Secured Party with presentment of Bonded Bill of Exchange to the Secretary of the Treasury, and the claim stamped “Accepted for Value ,” thus settling the matter, documented and authorized through the following: Public Policy HJR-192 Supreme Court confirmation in Guaranty Trust of New York v. Henwood, et al (1939) Title IV, Sec. 401 of the Federal Reserve Act Public Law 73-10 Foreign Sovereign Immunity Act An Affidavit not rebutted stands as Truth in Law.

Affidavit of Specific Negative Averment

One living, sentient, free-will natural man and woman known as Edward-Lewis:Brown and Elaine-Alice:Brown, Secured Parties, Creditors, and Holders-in-Due Course with unlimited commercial liability, hereinafter “One”, both singly and collectively, acting with rights granted by life and upheld by all valid and just law declares and attests that the following facts are true, correct, and complete to the best of One’s knowledge and in accord with One’s deeply held spiritual convictions and creed re God Almighty.

One issues this Affidavit of Specific Negative Averment, hereinafter “Affidavit,” on the basis that each and every party acting against One in any manner purports to be acting in an official capacity.

One denies that any of the below-named, undefined, and unproved beings/entities/persons/corporations/associations/trusts/unincorporated associations/limited partnerships/whatever exists, is solvent, has capacity to sue and be sued, can appear in court, and is in bona fide, enforceable contract with any alleged party:

The correct parties concerning any alleged dispute must be accurately and legally identified and present in court in order for any proceeding to commence, inasmuch as otherwise ambiguity prevails and no way exists to know who is involved with whom, how, and why, rendering any such proceeding, and all matters connected therewith and pertaining thereto void for vagueness as per 46 AmJur 2d. Judgments:

     100. Parties. A judgment should identify the parties for and against whom it is rendered, with such certainty that it may be readily enforced, and a judgment which does not do so may be regarded as void for uncertainty….

This Affidavit constitutes a “specific negative averment” in accordance with Federal Rules of Civil Procedure Rule 9(a) re alleged “UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #09-cr-30-CZS, UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #06-CR-00071-01/02-SM and any and all variations, allegedly involving some undefined and unproved beings/entities/persons/corporations/associations/trusts/limited partnerships/unincorporated associations/whatever referenced as “UNITED STATES OF AMERICA,” hereinafter “Fictional Agency, “CLAIMANT,” hereinafter “Fictional Claimant,” and EDWARD BROWN and ELAINE BROWN, hereinafter “Fictional Debtor/Defendant,” whereby One declares and asserts absolutely that:

None of the above-enumerated all-capital-letter assemblages of letters exists and is solvent.

One is none of said all-capital-letter assemblages of letters, i.e. not Fictional Agency, not Fictional Claimant, and not Fictional Debtor/Defendant, and is therefore a non-party to UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #09-cr-30-CZS, UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case#06-CR-00071-01/02-SM and any and all variations.

One’s true name is Edward-Lewis:Brown and Elaine-Alice:Brown, and not EDWARD BROWN and ELAINE BROWN.

One’s rank is that of unlimited-commercial-liability, living, sentient being with all absolute, unalienable rights, and power to uphold said rights, intact.

One’s standing in law is that of a sovereign inhabitant on the soil of the land commonly referenced as “New Hampshire.”

All assertions that One is a party to any proceeding concerning UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #09-cr-30-CZS, UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #06-CR-00071-01/02-SM and any and all variations, are null and void and of no force and effect ab initio. One is not a party to an imaginary dispute between non-existent and non-appearing entities.

UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #09-cr-30-CZS, UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #06-CR-00071-01/02-SM, and any and all variations, must be abated ab initio.

Fictional Agency and Fictional Claimant do not possess, and can never possess, jurisdiction over One, nor One’s property, nor One’s rights, and the issue of jurisdiction cannot be waived.

The record must be corrected re this matter immediately.

All parties whatsoever are estopped henceforth from acting against any of One’s rights and property in any manner re this matter.

Any man or woman desiring to rebut this Affidavit and disprove the negative averments asserted herein must rebut in the manner of this Affidavit, using Christian name for signature, executed true, correct, and complete and notarized, in red ink, and mail to the Edward-Lewis:Brown and the Elaine-Alice:Brown at 266 County Farm Rd., Dover, New Hampshire, 03820, within ten (10) calendar days of receipt or be in default hereof.. Said default establishes on the record the confession and consent of judgment by every man and woman acting adversely concerning One in any manner that:

None of the all-capital-letter beings/entites/persons/trusts/corporations/associations/unincorporated associations/limited partnerships/whatever referenced herein exists, is solvent, possesses “capacity to sue and be sued…or sue and be sued in a representative capacity, and can appear in court re this instant matter, whereby UNITED STATES OF AMERICA v. EDWARD BROWN and ELAINE BROWN, Case #09-CR-00030-01/02-CZSand UNITED STATES v. EDWARD BROWN and ELAINE BROWN, Case #06-CR-00071-01/02-SM, and any and all variations does not exist ab initio and Fictional Agency has no jurisdiction over the non-existent cause, the non-existent parties, and the non-existent thing.

Any man or woman who is in default hereof who continues to act against One in any manner is acting illegally, without authority, in private capacity, and in the complete absence of all jurisdiction.

One is fully authorized to employ any and all just and lawful means of remedy and recourse concerning action against One by any party who admits and confesses by default to be devoid of all right, authority, and official immunity.

Problem: Money, or the love of, has been said to be the root of all evil.

Answer: In that sense, I do not love money, I love the freedom that money brings.

Problem: Money can bind one to persons, groups, institutions, ideas which generally enslaves the spirit. How much money do you need in order to be free?

Answer:: Come to atonement with Spirit and not merely engage the mind with staunchly conditioned perceptions which inundate consciousness with habitually held ideas..

Problem: Money comes from relationship, therein again, a situation which tends to enslave rather than liberate at the conditioned level of consciousness.

Answer: Exercise all of one's manifest energy as Honesty and Truth objectified, not subjectified. Act Boldly. Let your words and your actions be as One.

Problem: How to establish any monetary relationship without being trapped by it?

Answer: Offer services for free whenever possible, Give away that which one has no use for, rather than dicker and negotiate to the nth degree.

Answer: Do not give advice, but rather relate to all others not in theory but only with one's Truth tested personal experiences (one's Truth) which may offer, if listened to quietly, the spiritual key to unlock another's personal psychological, and economic prison.

Answer: Accept donations with no strings attached. Give Freely and Receive Freely. That is the nature of Spiritual Oneness. (Golden Rule)

Answer: Stay away from legal contracts as much as possible. Let one's word be one's bond.   Do not invite 3rd party intercessor into any relationship. i.e. goverment.

Answer: Conduct all activities with Clarity and Truth and with intent to help. Those who are not worthy will not stick around long, and will take offense at being perceived by others at their lifelong habitual conditioned ideas, which they perceive are being under attack
