rk:  Her complaint to my ISP was that such libelous statements were copyrighted and demanded I take them down from my site.  Without investigation nor concern for the Truth, jaye mathisen (ceo of my former ISP, formerly known as InternetCDS in Medford OR, now known as Western Telephone Intergrated Communications) capitulated to the threat of litigation.  I told mathisen to turn the material I sent him over to the company lawyers, or at least do a preliminary investigation into these bogus complaints before taking any action.  In the meantime, I intended to withold my monthly service fee until the legal question was looked into.  mathisen, told me my Internet service would be shut down the next morning.  IT WAS!!

rk:  You have heard on the mainstream media news broacasts of the bizarre events occuring daily throughout our country, which, with every incremental step of legislative insanity, brings our Constitutional Republic to the brink of Destruction.

rk: The antidote to this INSANITY is to know who you are.  You, each of you, are of the Sovereign People unless you have sold your soul to Satan, the caretaker of all co-dependents.  Government is our Servant, it is NOT OUR MASTER. 

rk:  Change your legal status from debtor to creditor.  If you harm no one, do not cause damage to property or person, nor infringe upon another's Rights, the GOVERNMENT, the servant, is impotent to prosecute you under Common Law. However, if you have not changed your legal status and are still regarded by the State as a "ward of the state," an infant in the eyes of the law, then you remain a "Human Resource," an entity who has been sold into slavery lock, stock, and barrel, and exploited from the cradle to the grave.  What's crazy about this statement, is that millions and millions of so-called intelligent, educated (conditioned) people hear these words every day but the reality of them NEVER SINKS IN.

rk:  I have proved that freedom comes to those who are aware and will stand up to the illusion that is our Court System.  I have proved that through my unlawful prosecution/persecution by a legal, but unlawful, corrupt Oregon judiciary serving Josephine County, Oregon.  The cost:  I came close to death in the Josephine County Jail and they KICKED ME OUT long before the BOGUS sentence imposed upon me was served.  Why?  They feared they would have to explain why they held this man hostage unto death for the debts of another when they had NO JURISDICTION over this "living, breathing, flesh-and-blood, natural man."

rk:  My take is that it is a disinformation forgery put out by  the Government/media disinformation agents who base themselves in the AFAB newsgroup. They have forged many posts under my name and email address in the past.  This Information is supplied for  purposes of investigation. In order to keep everyone accountable, I am posting this publicly on the Internet also.

rk: My suggestion is that you verify with dean that she wrote it.  If she has not, JOSEPHINE COUNTY OREGON SHERIFF'S OFFICE is going to be put on the map for being the first law enforcement agency in the country which authorizes and condones the commission of forgery, Internet stalking, harrassment, conspiracy to libel and the copyrighting of criminal evidence,

rk:  By the way, when contact is made with dean, ask her to produce the evidence of the 100's of emails she claims were sent her by me. You will find that what she refers to are the reposting of articles on a her public forum bulletin board which concerned me posted on my website for the purposes of rebuttal. This is an example of a Cyberstalking letter.   In fact,
it was the letter I wrote informing the stalker that if
he did not stop "doing what he was doing", he would not be
doing it too much longer.

Needles to say, I was totally ignored, and I do believe he
started cranking them out faster than ever.   If you read
my other posting on different types of Cyberstalkers, you
will note the differing reactions each group has to his or
her willingness to cease or increase their damaging
behavior.

In reality, I did not respond to the modified version of my
e-mail,   In this example I did for several reasons.

1.  I wanted to see how it felt to cut someone down when they are
nowhere around to defend themselves. (Pretty damn good!)

2.  I have gone two months without saying a word in response which can be difficult when you read outright lies about yourself spread all over the web.  I had to let off some steam.

3.  I wanted to see how time consuming a job it is.  The answer is very time consuming and I can just not imagine what would drive someone to the point of spending their life typing out this junk.

4.  I wanted to study the wording in the stalkers letter back to me. Keep in mind that I have received hundrds of these, so I skim them. I had never actually taken the time to try to figure out what he was saying.   Well, I don't think anyone could ever figure out what he is  saying, but I found some very frightening words and sentences in this letter that I had totally overlooked.   They are towards the bottem of the letter, and I actually got chills when I realized the hatred I had
overlooked.

The lines with no initials are the phony ones.   They were never sent to the stalker.

Cyberstalking

Hi Everyone,

My name is Kathy L. Dean, and I have been a victim of Cyberstalking for two months now.   Since it is currently on-going and easily available for viewing, I thought this would be a good place to post this information.

I would like to bring up some mistakes I made, some things I should have done and some things I should not have done.   When you first start receiving mail from a Cyberstalker, it's quite a jolt to the senses.   In my case, it was from someone I had never met and did not know, other than speaking to him and his wife several times on the phone.   He was known as being "nutty" and people referred to him in not very nice terms, but from the beginning I realized he had some mental problems, and I never once said a derogatory thing about him in print or verbally.

If fact, on many occassions I would stand-up for him and expain he had a differing thought process from the rest of us, and just think how boring the world would be if everyone was the same.   Several people very close to me are suffering from bi-polar disorder, so I am aware of the problems people with mental disabilities have.

When I first started receiving the letters, I couldn't understand why a person that I had never done a mean thing to in my life would do this to me.   Plus, he was aware that both my husband and I were going through very stressful times with another issue, so why would someone try to hurt us now?   And, as we all know, if you are suffering from something, your mate suffers too.   So in realithy, he was attacking two very vulnerable people that had just gone through a traumatic experience.

What he was doing was taking e-mails that I had written and posted to a small Yahoo Site, copying and pasting them to his computer, and he would then disect my notes into sentences (or partial sentences) and insert comments inbetween.   He would initial each line with the initials of the person who was talking, in some cases fictional characters, and he would then take this "project" and paste it to his own website, plus dozens of user groups and web sites.   The web sites were normally religious in nature because he believes he is Christ.

Well, believe me, the first time you see one of you own e-mails
slaughtered in this manner, it's very upsetting.   The comments he inserts are never nice comments, they are rude, revolting, disguisting and totally lack any thought whatsoever for the writer of the note. If you are Jewish, your remodeled note, with name, e-mail and any other personal information could be pasted on a Christian website along with all his nasty comments included.   Plus, the way he arranges it, it looks to the casual observer like you are having a conversation with him.

My first mistake was ignoring my friends advice to immediately file charges for Cyberstalking and get a restraining order.   I didn't do this because I thought it would stop, and since this person already had numerous felonies and other charges on his record, I didn't want to be the one to add to his collection.   Plus, I was worried what other people would think.   Yes, I was suffering from what he was doing to me, but I was sure that any of his friends, and our newly acquired friends would not understand.   He is such a masterful liar and so fluid with his lying, that he does not think twice about charging you with something you have never even heard of belore!

So unless you have very good reason to think it's going to stop,
report the person to the police immediately.   Also go on line and pull up the DMCA rules if the person is using your own words against you via your e-mails.   What you write is yours.   You don't have to stick a big Copyright symbol on it, you own what you write.   Put a notice at the bottom of your web pages to be extra safe, or place a statement in one note in the user group and jot down that number.I'm a photographer, so I actually use the DigiMarc Copyright System on pictures, letters, e-mails, etc.  It embeds a watermark and all owner info directly into the pixels. plus is traceable to the computer that
has it.

Immediately contact the stalkers ISP and report what is going on and demand that the stalker's user status be cancelled.   Contact the stalkers e-mail provider and keep pounding them.  Do not reply to the stalker, but keep all e-mails in a safe place because you will have to hand the over to the police.   In my case, the stalker has generated over 500 of my altered e-mails, so copying them all would be impossible.   Thank goodness for search engines, or I would be lost!   Keep accurate phone records.   My stalker keeps his own phone records and announces to everyone when he phones me, so that makes it easy.

In the entire two months I have been Cyberstalked, I only contacted the person once, and that was several days ago to say that if he didn't stop it, I would press charges.   Make your statements clearly understood and to the point so there can be no misrepresentation of your words.  The police will ask you for verification that you did ask the person to stop.   If the stalker is considered "picked-on" or "down-in-his-luck" or has been to jail numerous times before to fight for "Justice, Freedom and the American Way", you will lose friends because they feel sorry for the stalker.   If you do, they were never friends anyway, and your sanity and life are far more important than
they are.

Cyberstalking's Impact on the Victim

While we have no formally analyzed or quantified data on the
psychological impact of cyberstalking, the types of responses reported by the WHO@ organization -- i.e., victims having to change telephone numbers, e-mail addresses, leaving the Internet, etc. -- suggest that cyberharassment and cyberstalking may produce the same kinds of traumatic distress as that experienced by offline victims for both domestic and nondomestic stalking.

Indeed, one could hypothesize that that stranger-stranger
cyberstalking might be more traumatic in some respects, as the victim doesn't necessarily know who their stalker is, doesn't know what the stalker looks like and may land up with tremendous anxiety or fear of all strangers. Consider the cyberstalker victim who doesn't know if their stalker is in their geographic area and doesn't know if their stalker has any history of stalking or violence. In this case, the "unknown devil" may be more frightening than a "known devil."

In discussing cyberstalking, Parry Aftab, the Executive Director of Cyberangels, said, "They are scared out of their mind and no one takes them seriously. The victim is victimized twice." Indeed, it may be hard for those who have not experienced it to appreciate how terrifying it can be to repeatedly get threatening e-mails from someone you don't know anything about. Or how, after being cyberstalked for months or years, a victim might become depressed or ill.

Simple Obsessional Stalkers:

Many published sources define simple obsessional stalkers in terms of the stalker being known to the victim. The stalker may be a former lover, an ex-spouse, or someone with whom the victim worked. Simple obsessional stalkers are thought to comprise the largest of the three categories, accounting for 47% of offline stalkers (Geberth, 1992). These individuals presumably stalk out of anger or hate or to obtain revenge for some real or imagined slight, but as the victims in the Tjaden and Thoennes study suggested, the motivation may be to control the victim or to keep the victim in the previous relationship. Not all formulations require a known or prior relationship between the victim and the stalker, however. For example, in discussing obsessional harassment or obsessional stalking, Rosenfeld (2000) states the following:

"A third group which accounts for a substantial number of obsessional harassment incidents is comprised of individuals who perceive themselves to be the victims of unfair treatment. These persons typically harbor intense anger and resentment over what they perceive as unfair or inappropriate behavior on the part of others. Politicians and judges appear particularly vulnerable to this form of harassment,although employers, police officers, and other authority figures may become the victims as well.Unlike the two previous forms of harassment, these individuals are typically motivated by revenge rather than affection." (p. 532)

Obsessional stalkers may use or exhibit a number of defense
mechanisms, and denial, devaluation, and projecting blame onto the victim are just some defense mechanisms discussed in the literature. They are also thought to represent the greatest threat of physical violence to their victims. Such individuals are reportedly more likely to have a personality disorder related to attachment pathology and less likely to have an antisocial personality disorder when compared to other offenders with mental disorders. They are also likely to be older, smarter, and better educated when compared to other types of offenders with mental disorders (Meloy & Gothard, 1995). Morrison (2001) reported on 100 Canadian males who had been arrested for criminal harassment (stalking). The typical profile of the "simple obsessional" stalker in their study was a middle-aged male who was separated or estranged, and who had a history of anger management or
emotional problems.

Rejected stalkers are motivated by a desire for reconciliation and/or revenge. In the rejected stalker subtype, personality disorders predominated. Rejected stalkers were predominantly male, accounted for slightly over one third of all stalkers in the sample, and were viewed as the most persistent and intrusive stalkers.

Intimacy-seeking stalkers identify their victim as their true love and often imagine that their victim reciprocates their feelings. Intimacy-seeking stalkers accounted for one third of the entire sample. Although delusional disorders were fairly common (30%) in the entire sample, they were particularly among intimacy-seeking stalkers. Like rejected stalkers, intimacy-seeking stalkers tended to stalk their victims for significantly longer periods of time than other types of stalkers.

Incompetent stalkers, who comprised 15% of the sample, are described as those whose stalking is maintained by hopefulness that their victim will be "won over."  Such stalkers usually do not persist for long, but many may then switch over to another victim and repeat the process.

Resentful stalkers, who constituted 11% of the sample, are generally aggravated employees or those who feel that they have been mistreated or humiliated. They may pick one person to focus on and stalking that person makes them feel powerful. Despite being confronted with their behavior and its inappropriateness, they are likely to maintain that they are the one being persecuted, and they are very noncompliant with or resistant to treatment. Threats and property damage were more frequent with resentful stalkers, but rejected and predatory stalkers committed more assaults on the person. Predatory stalkers, who made up only 4% of the sample, are those who stalk in preparation for physical or sexual assault. They are likely to have histories of criminal sexual convictions, and require treatment appropriate to sex offenders.

Most stalkers are lonely and socially incompetent, but all have the capacity to frighten and distress their victims. Cyberstalking Rules and Regulations for the State of Oregon (Stalking and Harassment)

STATE: OREGON

163.732 Stalking.

(1) A person commits the crime of stalking if: 

   (a) The person knowingly alarms or coerces another person or a
member of that person's immediate family or household by engaging in repeated and unwanted contact with the other person;

   (b) It is objectively reasonable for a person in the victim's
situation to have been alarmed or coerced by the contact; and

   (c) The repeated and unwanted contact causes the victim reasonable apprehension regarding the personal safety of the victim or a member of the victim's immediate family or household.

(2)(a) Stalking is a Class A misdemeanor.

   (b) Notwithstanding paragraph (a) of this subsection, stalking is a Class C felony if the person has a prior conviction for:

 (A) Stalking; or

 (B) Violating a court's stalking protective order.

 (c) When stalking is a Class C felony pursuant to paragraph (b) of this subsection, stalking shall be classified as a person felony and as crime category 8 of the sentencing guidelines grid of the Oregon Criminal Justice Commission. [1993 c.626 §2; 1995 c.353 §2]

Note: See note under 163.730.

 163.730 Definitions for ORS 30.866 and 163.730 to 163.750. As used in ORS 30.866 and 163.730 to 163.750, unless the context requires otherwise:

(1) "Alarm" means to cause apprehension or fear resulting from the perception of danger.

(2) "Coerce" means to restrain, compel or dominate by force or threat.

(3) "Contact" includes but is not limited to:

    (a) Coming into the visual or physical presence of the other
person;

    (b) Following the other person;

    (c) Waiting outside the home, property, place of work or school of the other person or of a member of that person's family or household;

    (d) Sending or making written or electronic communications in any form to the other person;

    (e) Speaking with the other person by any means;

    (f) Communicating with the other person through a third person;

    (g) Committing a crime against the other person;

    (h) Communicating with a third person who has some relationship to the other person with the intent of affecting the third person's relationship with the other person;

    (i) Communicating with business entities with the intent of
affecting some right or interest of the other person;

    (j) Damaging the other person's home, property, place of work or school; or

    (k) Delivering directly or through a third person any object to the home, property, place of work or school of the other person.

(4) "Household member" means any person residing in the same residence as the victim.

(5) "Immediate family" means father, mother, child, sibling, parent, spouse, grandparent, stepparent and stepchild.

(6) "Law enforcement officer" means any person employed in this state as a police officer by a county sheriff, constable, marshal or municipal or state police agency.

(7) "Repeated" means two or more times.

(8) "School" means a public or private institution of learning or a

Note: 163.730 to 163.753 were enacted into law by the Legislative
Assembly but were not added to or made a part of ORS chapter 163 or

 166.065 Harassment.

(1) A person commits the crime of harassment if the person
intentionally:

    (a) Harasses or annoys another person by:

 (A) Subjecting such other person to offensive physical contact; or

 (B) Publicly insulting such other person by abusive words or gestures in a manner intended and likely to provoke a violent response;

    (b) Subjects another to alarm by conveying a false report, known by the conveyor to be false, concerning death or serious physical injury to a person, which report reasonably would be expected to cause alarm; or

    (c) Subjects another to alarm by conveying a telephonic,
electronic or written threat to inflict serious physical injury on that person or to commit a felony involving the person or property of that person or any member of that person's family, which threat reasonably would be expected to cause alarm.

(2) A person is criminally liable for harassment if the person
knowingly permits any telephone or electronic device under the
person's control to be used in violation of subsection (1) of this section.

(3) Harassment is a Class B misdemeanor.

(4) Notwithstanding subsection (3) of this section, harassment is a Class A misdemeanor if a person violates subsection (1) of this
section by subjecting another person to offensive physical contact and the offensive physical contact consists of touching the sexual or other intimate parts of the other person. [1971 c.743 §223; 1981 c.468 §1; 1985 c.498 §1; 1987 c.806 §3; 1995 c.802 §1; 2001 c.870 §2]
