If I contract to remove your appendix, the state has no business

The state Supreme Court issued a sweeping ruling yesterday that could mean thousands of people whose driver's licenses were suspended won't be prosecuted.
In a 5-4 ruling, the court struck down two state statutes as
unconstitutional because the laws don't provide for an administrative hearing or an appeal procedure and thus deny individuals due process guaranteed by the Constitution.
At issue is the state Department of Licensing's (DOL) lack of a formal hearing or appeal process for people whose licenses were suspended after they didn't appear in court or pay traffic tickets.
Yesterday, state and city attorneys were scrambling to understand the full implications of the ruling. In Seattle, the ruling could have serious ramifications and a huge financial impact because of the city's controversial impound policies, which the City Council recently voted to scrap for drivers cited for third-degree license suspensions.
Drivers arrested for third-degree license suspensions typically have their licenses lifted because they failed to pay tickets for minor traffic violations, such as speeding. In contrast, drivers arrested for first- and second-degree license suspensions are those whose licenses were suspended for being habitual traffic offenders, driving while intoxicated, reckless driving and other serious traffic offenses.
"It seems to me that any (third-degree) license suspension in the state of Washington is currently unconstitutional because it doesn't comply with due process," said Donna Tucker, one of two Bellevue attorneys who argued before the Supreme Court to have the statutes struck.
Potential for error
The case was brought before the Supreme Court after the city of Redmond sought direct review of a King County District Court decision to dismiss charges against two men, Jason Wilson and Dean Moore, for driving with suspended licenses.
Wilson's license was suspended for failing to deal with a speeding ticket, and Moore's was lifted for failing to resolve a citation for driving without liability insurance. A district-court judge concluded the suspensions didn't comply with due process because DOL failed to provide the opportunity for an administrative hearing and so dismissed the charges.
In writing for the majority, Justice Richard Sanders said the statutes "are contrary to the guaranty of due process because they do not provide adequate procedural safeguards to ensure against the erroneous deprivation of a driver's interest in the continued use and possession of his or her driver's license."
There is substantial potential for error in DOL decisions to revoke a driver's license, especially given that DOL issues some 300,000 suspension notices a year based on information from the courts, Sanders wrote. When a driver receives notice his or her license is to be suspended, the individual has 30 days to resolve the issue in court.
"He or she is not, however, offered any procedure to contest the
suspension other than being instructed by the notice to resolve the matter with the court," Sanders wrote. "The public is left to its own devices to secure a timely hearing from a court to reverse the error before the suspension takes effect."
Burden on DOL
But in a seven-page dissenting opinion written by Justice Bobbe Bridge, four justices argued that just because there's a potential for error, no evidence was provided to show a pattern of erroneous license suspensions.
The dissenting justices also pointed out that requiring DOL to give an administrative hearing to anyone whose license is suspended would require vast public resources for the staff, time and space to conduct such hearings.
"The majority seizes upon the scant record in these cases to answer a question that has not been raised by any party and in so doing stretches the requirements of due process beyond precedent and common sense establishing no clear benefit for the licensees and burdening an administrative system designed by the Legislature to provide swift determination for the protection of the motoring public," Bridge wrote.
Gerald Anderson, an assistant attorney general who advised DOL on the case, said his office is still trying to digest the court's ruling. Because the court struck down the statutes, it's unlikely DOL can devise an administrative remedy, he said, adding "it's too early to speculate what legislative remedies are possible."
A Redmond city prosecutor and a DOL spokesman would not comment
yesterday, both saying they needed more time to analyze the decision.
Financial impact
The impact could be huge for Seattle, which has seized, towed and held almost 5,000 vehicles a year from drivers with third-degree license suspensions. Roughly 30 percent of those vehicles are scheduled for auction because their owners could not pay fees, fines and storage charges. But the city doesn't track how many are sold, said Kathryn Harper, spokeswoman for the City Attorney's Office.
Some lawyers believe the city faces potential financial liability for vehicles seized under its Operation Impound program.
"I think a strong argument can be made that all seizures were unlawful and drivers deserve compensation. This would be additional legal basis for that argument," said Lisa Daugaard, a public defender and outspoken critic of Seattle's impound law.
The number of drivers who might seek compensation, the amount they might want and the validity of their claims remain to be seen.
But a very rough estimate of $10 million in damages is reasonable, said Adam Berger, an attorney who has brought a class-action lawsuit against the city's former policy, which was in effect from 2000 to late 2002. After that, police officers exercised discretion but still impounded the vehicles of 80 percent of the drivers they cited for third-degree license
suspensions.
Berger's estimate is based on the premise that there could be 10,000 drivers seeking compensation, with claims of about $1,000 each, on average.
Meanwhile, impound opponents who pushed the City Council to dump the controversial impound law in a 6-2 vote two weeks ago said the court's decision validated their arguments.
"It's a welcome decision as far as I'm concerned," said Councilwoman Jean Godden, who co-sponsored the ordinance to repeal the impound policy.
Seattle Mayor Greg Nickels signed the ordinance into law yesterday.

On Nov 2 1997 a complaint was lodged with the Medford field office of the FBI, demanding an investigation of Government/Media
Sponsored/Supported Disinformation Agents practicing Mind Control
upon unwary Internet Users.
This investgation has been ongoing for 6½ years now. Their is
circumstatial evidence of Sen Ron Wydens office trying to stymie the investigation, under the pretence of helping.
Can you tell us anything abuut the status of this investigation. We know at least 2 JoCo residence are awaiting the conclusion of the Federal Criminal Investigation to pave the way for them to collect civil damages for Conspiracy to Libel. It is likely liens will be placed.
Thanks for any information, or if the JCSO doesnt know anything about this long anticipated for momentum, maybe the sheriffs office is one of the targets.

The government/media mind-control/disinformation agents have recently ratcheted up their pot-stirring character assassination program on the Internet. I have been writing about this issue since the FBI first refused to take action on a Nov 2, 1997 criminal complaint filed with their Medford, Oregon Office. These same arrogant disinfo people who boast of immunity from prosecution are the source of the trashed petition found at http://www.petitiononline.com/RayNita1/petition.html
The simple Truth is, the American public is a deliberately dumbed-down population, who, by their actions, indicate they do not deserve to live in freedom. They are "easy pickins" for the intimidators of a growing Police State.
They have been made unaware and insensitive to the subtleties of mind-control/disinformation operations. Even when it goes beyond the subtle realms of consciousness and becomes grossly implemented in the Satanic Intellect. As of now, the people's reaction is to increase their complaining, but do nothing about it.
They are blind believers, made to be codependent, ignorant and impotent in dealing with their problems. They have been trained to take their problems to the government. They have been trained through long-term, incremental conditioning to jump through the hoops/maze/channels of a complex bureaucratic system. Yet when such hoops are jumped through, such mazes are navigated, and channels are followed, the govermnent refuses to act. They refuse to do their jobs, and ultimately demonstrates their corrupt unresponsiveness to the plight of the people by erecting a STONE WALL OF SILENCE.
BIG HELP, HUH???
I have been writing of this cancer which is the cause of our dying Republic for years -- long before the attack upon American Sovereignty, traced to 9-11, which jostled some sleeping "munchkins" to a state of partial awareness so that their fears might be exploited, and their rights stripped away.
It is this conditioned inertia and impotence of the populace that will be the undoing of the formerly free people of this once great country. They have lost their intelligence, their discrimination, and their will to stand on their own two feet and solve their own problems.
They are the spiritually dead led by the spiritually dead who will fulfill their cannon fodder status when they are pushed to the wall, their freedoms stripped away and fear has overwhelmed them. It is then they will pick up the gun in violent revolution. They will reap what they have sown. They will get exactly what they have set into motion. They will get what they deserve.
Those who control them in mind and body know this. They have factored such inevitability into their plans and can only do so through incremental tactics of divid and conquer.
The solution to this by the PEOPLE is BOYCOTT, BOYCOTT, BOYCOTT!!

My Dear Sirs and Madams,
After reading, or may I rephrase that to scanning, these numerous articles on this wicked person by the name of Madam Kathy Lynn Dean, I feel as if I must extend my sincere sadness over what you all must be suffering by her constant postings to this forum.
Is there anything I can do to help? Although fairly new to Southern Oregon, I do happen to know some influential people that might be able to help. Several are in the Internet field, and I am sure that her repeated postings at these sights in some way must be illegal. If not termed SPAM, it could be classified as harassment or libel. I will try to contact a board leader of some sort and see if she can be banned from using these groups. I must have come across her name hundreds of times in just this one session of browsing this evening.
I feel especially sorry for a Master Raymond Karczewski who she seems to be addressing most of her vile notes to. I personally have run across these types of women whores before, and it matters not how politely you ask them to stop writing to you, they continue to keep it up. Is she somehow infatuated with Master Karczewski that she keeps posting to these boards? Maybe a love gone sour? Should a restraining order be brought against her? Can the police be brought into this to see that she cease and desist from posting at these groups? Can a ban be placed upon her for her repeated notes? I did not have the time nor patience to read all postings, but her name appeared over and over on so many related topics, that someone should state enough is enough!
I printed out many of the notes, and I do have contacts in higher positions. I will bring this to their attention tomorrow, and we will see if we can get a stop to this nonsense. I am truly surprised she has not been banned just from the volume alone of her postings.
My sincere heartfelt sorry for Master Karczewski for having to put up with this bitch, and we will see if we can get this absurd abuse of these posting boards stopped immediately.

Can you grasp what Ray is dealing with. Do you not know Ray is a Christ and A CHRIST MUST BE ABOUT HIS FATHER'S BUSINESS.
What his doing is much more than just protecting chicken rustlers. Ray is healing a SPIRITUAL SICKNESS. That is spread all across the whole land. You are just helping that in a small way. Do you think his whole mission must be about you.
This forum is just one of many. Raymond must post his message everywhere its not blocked from. That is why he has taken every email and post to you, and from you, and everything from this list, and shared it in DOZENS of mailing lits, web boards, and news groups. This is an ACT OF LOVE. And if he should take your message so far and wide. then how much more should you, a foot soldier in Ray's army, not interfear with Raymond sharing this HOLISTIC (whole) message with this board. Many govt agents are working to block Ray's Message. He is "BANNED" from some places, disinformation,libleous accusations of SPAM, ect. Are you on there side? Or what.

Truth. The way of Christ includes a way of life and living. It is truth that
dictates the actions and acts of a Christ. Truth is the power of a Christ.
As has been said, "knowledge is power" but knowledge of truth is the

The person possessing the mind and spirit of Christ possesses the power to

of God. Then perhaps he could see and understand the prize the apostle Paul

But the religions of man have created the paradigms and the chains that hold
people preventing them from seeking truth. Mankind is mired down in the
lower valleys following the pipers along the way of religionists. No they
say, it is not possible to know God nor to be Christ. For they have learned
this teaching and never have they sought to know the truth of the matter for
truth is not of value to a religionist.

The hunger strike was effective of one standing in-law while focusing public attention upon the corruption of the "color of law" system operating in the Josephine County Oregon Courts and Law Enforcement Agencies. The risk taken via the hunger strike was an act of Truth, a direct action, uncompromised by doubt, the purpose of which was to awaken my sleeping brothers and sisters to the serpent intellect which rules them. Although I am now out of jail, my brethren continue to slumber on, oblivious to the forces which enslave them.

The courts and the District Attorney's office still have not answered any of my court interrogatories in either case. In other words Mohamad, they have not, according to common law proved that I have committed a crime, yet I am labeled a felon. The true felons are the corrupt Josephine County Oregon District Attorney and Judges who have cooperated in such a conspiracy to perpetrate fraud upon the public. To ignore that Mohamad is to feed such insanity. As the old saying goes, "Its a dirty job, but somebody's got to do it." It is through doubt and fear that civilized man is controlled by his leaders.
