Affidavit of Conditional Acceptance and REQUEST FOR DETERMINATION OF SCOPE OF OREGON LAW ENFORCEMENT ACTING BEYOND THE LAWFUL PARAMETERS  OF THEIR LIMITED POLICE AUTHORITY.

At Approximately 11:10 AM, June 6th, 2009 I, Raymond Ronald Karczewski©  was Travelling South on Hwy 199 at approximately 20mph on my Piaggio Motorscooter. in downtown Cave Junction in front of Taylors Sausage deli/restuarant, when HERTEL  driving in the left lane, without signalling swerved into the Right lane that I was occupying.  I braked hard and lost control of the bike taking a spill. in avoidance of a direct collision.   HERTEL FULLY ADMITTED TO FAULT IN THE ACCIDENT . I suffered multiple abrasion on body, legs and arms.  Deep Lacerations upper left forehead, and broken ankle. I refused ambulance service, but later had a friend take me to the Hospital for treatment.  Pictures of the injuries were taken by Trooper Walker.  

I thought I was alright and since my bike is self-insured,  HERTEL and myself were at first going to settle on the scene but the damages were too great on the bike.The State Police were called on the scene.  A BLM enforcement officer was first on the scene.  followed shortly by the ambulance.  

A full statement was given  by both HERTELL and myself to Trooper Walker and was recorded .  As in past traffic stops, I advised WALKER that I was not required to have an Oregon  Driver License, as I was using the motorscooter for private travel and was not engaged in Commerce.  Nor was I required to have Registered  OREGON State Plates on my PIAGGIO,  as I presented him with the Original Manufactureres, CERTIFICATE OF ORIGIN given to me at time of purchase by the dealership, showing the State had no financial interest in the bike and thus Registration was therefore not required.  I showed Walker all of my UCC paperworks showing that I was not a subject of the State Corporation and its regulatory policies government Commercial Use of the Highways.  He ignored them.

The Piaggio was on private property, did not pose a traffic hazard, nor was it fully disabled, and I had committed no crime. These removed the general cause for impouindment by Law Enforcement    I called a friend to take it home for me as  Trooper Walker  indicated that computer records show that my License has been suspended.  I called a friend to take the bike home for me as WALKER had not yet decided to IMPOUND IT.  

I advised WALKER that the information on the police computer of my suspension  was bogus as I rescinded my Oregon Driver license in 1999 and I have not had an ODL for 10 years, therefore there  was no license to be suspended by the STATE..  On Sept 5th, 2002, I was arrested at gunpoint for the same bogus charge.  See: http://www.arkenterprises.com/dialch64.htm#Pirate

It shows the scam of District Attorney CLAY EDWARD JOHNSON. telling Judge how to do her job and demanding  that I sign  a notice of Suspension before they will release me from Jail..  I refused to sign it, and JOHNSON stated that I could not be released until such notice was signed  Judge BAKER assured me that it was a notice of suspension and does not constitute an admission of guilt on my part..  She said it had not bearing on anything other than a paper which implied I was
suspended.  This, even though no such license existed to suspend since 1999. The court records will show that I was coerced into signing the Notice..   IT IS THAT DOCUMENT WHICH is the basis for the information contained in the Police Computer which "authorizes" Oregon Law Enforcement officers to Impound my automobiles.  Judge BAKER stated that signing or not signing the document has no bearing on my license being suspended.   Based on this issue, Commercial defaults have proliferated when THE COURTS DISTRICT ATTORNEY, SHERIFF,  and ATTORNEY GENERAL  have refused to address the questions of JURISDICTION over this Living, Breathing, Flesh-and-Blood, Sentient, Natural Man  accompanied by Oath or Affidavit. On the sentencing court record, I  rejected the sentencing contract.  I  have not appeared in any courts arising from thses unlawful Traffic Stops which have infringed upon  my Right to Travel. and I have not paid a cent in fines, court costs, assesessments etc, even when judges reduced the charges from Driving with a Suspended Licensed to failure to present a license filing a fine of $8.  http://www.arkenterprises.com/hull1.jpg  

I did not pay any monies to the court.  I spent no time in prison.  I spent no time under probation.  I was set free and never brought before the courts again.   I did not accept any contracts for probation, and I continue to do the very things for which I was arrested originally, and they will not arrest me and/or bring me before a court because they would have to answer the question of JURISDICTION.  Pay attention to District Attorney CLAY EDWARD JOHNSON  coercing a signed contract in order to release me from jail. District attorney JOHNSON along with two judges and Sheriff were forced into retirement as a result of their handling of my case, yet for the last 7 years, the bogus suspension Information remains on the Police computer.

What Proof do I have that my position is sound in Law and the State of OREGON and County of JOSEPHINE has been caught with their pants down for exercising  Unlawful, UnConstitutional "Color of Law" Corporate policies.   IT IS THE FACT THAT THEY WILL NOT ARREST ME AND BRING ME BEFORE A JUDGE EVEN THOUGH I have refused to appear in court on the traffic issues, and NO WARRANTS HAVE BEEN ISSUED, NOR SERVED.

I, Raymond Ronald Karczewski©, a Living, Breathing, Flesh-and-Blood, Sentient, Natural Man, am the Secured Party/Creditor, Holder in due course, and Authorized Representative for the Juristic Person RAYMOND RONALD KARCZEWSKI©,  I am not an accommodation party nor a surety for the debts of RAYMOND  RONALD KARCZEWSKI© .

I, Raymond Ronald Karczewski©, am held harmless by  RAYMOND RONALD KARCZEWSKI© in HOLD HARMLESS AND INDEMNITY AGREEMENT NO: RRK-050302-HHIA, dated the Third Day of the Fifth Month in the Year of Our Lord Two Thousand and Two, against all claims, legal actions, orders, warrants, judgments, demands, liabilities, losses, depositions, summonses, lawsuits, costs, fines, liens, levies, penalties, damages, interests, and expenses whatsoever, both absolute and contingent, as are now due, and as might become due, now existing, and as might hereafter arise, and as might be suffered by, imposed on, and incurred by RAYMOND RONALD  KARCZEWSKI© for any and every reason, purpose, and cause whatsoever. Said Hold Harmless and Indemity agreement is filed with the Josephine County Criminal Court Clerk's office.

Attached to this Affidavit of Conditional Acceptance: Request for Proof of Claim is Citations #E636509  iissued by OREGON STATE TROOPER WALKER for driving while suspended.  Twas the kind of Satanic magic, the Josephine Courts and local government have become well known for, since THERE WAS NO DRIVER LICENSE TO SUSPEND.  I had rescinded my Oregon Drivers license in 1999.   

This Living Breathing, Flesh-and-Blood, Sentient, Natural Man is fed up unlawful, Unconstitutional, Rights Infringment tactics of a  corrupt Corporate Security force JOSEPHINE COUNTY SHERIFF, GRANTS PASS PUBLIC SAFETY, AND OREGON STATE POLICE backed by an Unconstitutional Administrative Court who will not recognize a man who stands and derives his Right in God's Law, Common Law, and the US Constitution and has not consented to contract with the Limited Authority of a Contract Administrative Court.

If the Sovereign People of Oregon and these united states of America understood the importance of this question of Government having Jurisdiction over Fictional Juristic Persons only, or over those who have willingly waived their rights and consented to granting the courts jurisdiction, THOUSANDS of innocent people languishing in prisons all over America  today would be set free because of criminal fraudulent actions committed by judges and prosecutors throughout the land.

This issue of government proving it has jurisdiction over Living, Breathing, Flesh-and-Blood Sentient men and women who steadfastly hold to their Rightful position as those of the Sovereign People goes to the very heart of Freedom in our land.  It is as important as the IRS law that doesn't exist which have put Ed and Elaine Brown in prison for asking the courts to SHOW THEM THE LAW.   In my case I demand you answer in writing as the law demands, the PROOF OF JURISDICTION of any Corporate Law Enforcement Agent over me, this Living, Breathing, Flesh-and-Blood, Sentient, Natural Man who is not a surety for the debts of the Juristic Person which sounds like my name..  Not a single agent in the employ of the State of Oregon and/or County of Josephine has answered those questions since they were demanded of the court and prosecution from the very first appearance, to the last in this issue which began on September 6th, 2002., SEVEN YEARS AGO.

I am posting this on the Internet and notifying Americans of the Fraud being perpetrated upon them by Oregon government officials. 

Here, once again are the 23 question of JURISDICTION accompanied by affidavit that I ask be answered by you, point by point accompanied by Oath or Affidavit,  since the Josephine County Sheriff, Prosecutor and Judges. who administer "Color of Law Policies"  WILL NOT ANSWER THEM.  That is the issue of Law which all men of the Sovereign People who have not consented to, contracted with,  nor waived their Rights when forcibly brought before the limited Administrative Courts and challenge the court to prove JURISDICTION over those  who gain their Rights from the Creator, Common Law, and the US Constitution.  I now give you the same opportunity to answer these questions of Jurisdiction:

Natural Man, accept for value all terms of citations upon proof of Claim established
by your answering the following questions accompanied by your sworn oath or
affidavit:

   1.  PROOF OF CLAIM on how the Oregon Constitution operates upon me,
Raymond Ronald Karczewski©, a living, breathing, flesh-and-blood, sentient,
natural person, the private man.

    2.  PROOF OF CLAIM on how the State statutes by and through the Oregon
Legislature and the DMV operate upon me, Raymond Ronald Karczewski©, a
living, breathing, flesh-and-blood, sentient, natural person, the private man.

    3.  PROOF OF CLAIM that the name appearing on the charging instrument, in
capital letters; RAYMOND RONALD KARCZEWSKI, is not a corporate fiction,
but is the name of the living, breathing, flesh-and-blood, sentient, natural person,
the private man in his private capacity.

    4.  PROOF OF CLAIM that the Oregon Revised Statutes (ORS) describe any
other class of license other than for commerce or for commercial trade, occupation
or profession.

    5.  PROOF OF CLAIM  that this private man is specifically named in the Oregon
State Statutes and more specifically ORS cites as applied in this matter.  (See the

person/private man.

    7.  PROOF OF CLAIM that the COUNTY OF JOSEPHINE, in its Corporate
capacity, has Jurisdiction over this living, breathing, flesh-and-blood, sentient,
natural person/private man, the Secured Party, Raymond Ronald Karczewski© in
his private capacity unless consented to, and/or contracted for, by that natural
person/private man.

    8.   PROOF OF CLAIM that all "Officers of the Court," which include members
of the JOSEPHINE COUNTY DISTRICT ATTORNEY'S staff, are under oath of
office to support and defend both U.S. and OREGON Constitutions.

    9.   PROOF OF CLAIM that Deputies and/or Jail Staff, in their capacity as
Agents for the CORPORATE JOSEPHINE COUNTY SHERIFF'S
DEPARTMENT, are bound by their oath of office to support and defend both U.S.
and OREGON Constitutions.

    10.   PROOF OF CLAIM that the CIRCUIT COURT OF THE STATE OF
OREGON FOR JOSEPHINE COUNTY, in its Corporate capacity, has Jurisdiction
over this living, breathing, flesh-and-blood, sentient, natural person/private man,

consented to, and/or contracted for, by that natural person/private man.

    11.   PROOF OF CLAIM of the existence of the liability and how it was created.

('The State') or the de-facto state ('This State'), a mere corporation.

    13.   PROOF OF CLAIM that the State of Oregon DEPARTMENT OF
TRANSPORTATION, DMV, through its Administrative Drivers Licensing process,
has Jurisdiction over this living, breathing, flesh-and-blood, sentient, natural
person/private man, the Secured Party, Raymond Ronald Karczewski© in his
private capacity unless consented to, and/or contracted for, by that natural
person/private man.
 
    14.  PROOF OF CLAIM that in my private capacity, that I, Raymond Ronald
Karczewski©, a living, breathing, flesh-and-blood, sentient, natural person, the
private man, is subject to Class A, B, and C commercial driver license.
 
   15. PROOF OF CLAIM that the State of Oregon via the DMV sells any other
‘driver’ license.

    16.  PROOF OF CLAIM that the Motor Vehicle code does not operate upon all
‘drivers’ of ‘all’ vehicles owned or operated by ‘the United States,’ ‘this state,’ ‘or
any county,’ ‘city,’ ‘district,’ ‘or any other political subdivision of this state’ … and
thus operates upon this private man. (see ORS 801.020)

    17.  PROOF OF CLAIM that my ‘private' vehicle is not a ‘recreational’ vehicle
that is operated solely for personal (private) use. (see ORS 801.208)

    18.  PROOF OF CLAIM that my ‘private' vehicle is used for the transportation
of persons for compensation or profit, or designed or used primarily for the
transportation of property (for hire). (see ORS 801.210)

    19. PROOF OF CLAIM that Raymond Ronald Karczewski©, a living, breathing,
flesh-and-blood, sentient, natural person, the private man, was a licensee at the time
of the ‘stop’ to subject himself to the motor vehicle code by agreement and as a
signatory. (see Vehicle Traffic Law, 1974 Rev Ed., page 238, 239)

    20. PROOF OF CLAIM that, “In view of this rule a statutory provision that the
supervision officials “may” exempt such persons when the transportation is not on a
commercial basis means that they “must” exempt them, generally applies in this
matter.  (State v. Johnson, 243 P. 1073; 60 C.J.S. section 94 pg 581)

    21. PROOF OF CLAIM that Raymond Ronald Karczewski©, a living, breathing,

light of ORS 801.305.

established a ‘liability bond’ in this action to indemnify Raymond Ronald
Karczewski©, a living, breathing, flesh-and-blood, sentient, natural person, the
private man, in the event of any damnification.

BRUST, JOSEPHINE COUNTY TRIAL ADMINISTRATOR answer these Jurisdictional questions once and for all under Oath or Affidavit based based upon your private, unlimited Commercial liability regarding the Natural Man Raymond Ronald Karczewski within 10 days of this registered mailing.  A non-response and/or failure to provide proof of claim will constitute agreement that charges Driving While Suspended brought against this living, breathing, flesh-and-blood, sentient, natural man, Creditor and Secured Party, Raymond Ronald Karczewski© are unfounded in common law and that Secured Party/Creditor's position is True and Lawful, and his Unalienable Right to Liberty which includes the Right to Travel is being systematically infringed upon by the OREGON STATE POLICE JOSEPHINE COUNTY SHERIFF'S OFFICE AND GRANTS PASS DEPT. THEREFORE: if such proof of JURISDICTION is not possible,  the bogus information of suspension MUST BE REMOVED from the OREGON Police Computers, and an acknowlegment that my position as a man of the Sovereign People having the Right to Travel as other living, breathing, flesh-and-blood, sentient natural men or women of the Sovereign People shall be adopted by OREGON Law Enforcement
